    It should be made public. It won't hurt the trial fairness since that is already over. Since this was evidence, the public has a right to see it.

    I'm actually kind of surprised that it hasn't been made public already. Think of how much TMZ, Page Six or the other gossip sites would have paid for it. Would every single person with remote access to the tape have been able to turn down that kind of money? Or did OU/boosters pay even more to make sure it didn't get leaked?

    The Ray Rice video got to TMZ by a security working using a cell phone to record it while viewing it on the hotel's security devices; it should have been just as easy for someone to do something similar at the Norman restaurant.

    When attorneys show evidence to juries and judges during trial, the photographs and video can also be seen by anyone in the courtroom. Judges’ decisions, which are based on such evidence, are likewise a public record unless the case itself is sealed. But those facts do not guarantee the public access to the physical evidence in a trial. And gaining access to the same material once a trial has ended can be even more complicated, as trial courts often return the evidence to the parties or the rightful owners. As such, taking steps to help coordinate the logistics of getting access to these materials as soon as you know you plan to cover a trial often helps the process go smoother and faster.

    As noted in other sections, the public's right of access to judicial records is protected by various legal sources. After-the-fact access to evidence, however, is less certain, although some courts have adopted the view that the public has a right to access such evidence, absent exceptional circumstances.

    For example, the U.S. Court of Appeals in New York (2nd Cir.) ruled over thirty years ago that "[o]nce the evidence has become known to the members of the public, including representatives of the press, through their attendance at a public session of court, it would take the most extraordinary circumstances to justify restrictions on the opportunity of those not physically in attendance at the courtroom to see and hear the evidence, when it is in a form that readily permits sight and sound reproduction."

    More recently, the U.S. Court of Appeals in Richmond, Va. (4th Cir.) reached a similar conclusion in the terrorism trial of Zacarias Moussaoui, ordering the trial court to provide the media with next-day access to all documentary evidence that had been published to the jury. Like the Second Circuit, the Fourth Circuit based its decision on the public's right of access to judicial records.

    Other courts, however, have declined to provide public access to copies of evidence used in court. A federal court in Colorado, for example, denied a request for access to autoposy photographs used in court, citing privacy concerns.

    I suspect shenanigans are at play, which is probably what led to the motion of dismissal to be overturned.

    By all accounts, Joe Mixon was provoked verbally and by physical attack, then punched a woman smaller than him with a lot of force. There is a very good chance that in the future, said imagery will be in public domain. Prepare yourself accordingly, whether you agree with the decision to release the video or not.

    I wonder if Knighton is ready to end his own legal career over spoliation of evidence. If he allowed the tape to be destroyed - especially within the two years time the victim has to continue civil action - he will likely lose his license to practice law.

    Imagine that...a lawyer so stubborn, he'd trade his license to practice law for a college football player's eligibility. Stupid.

    I hope they are also preparing for its release, because even if the courts don't, someone will have dollar signs in their eyes eventually.

    From a football standpoint, I understand why they were trying so far to get DGB eligible despite all of the bad PR it entails... we were thin at receiver that season and needed someone else besides Sterling who could catch. However, we have a lot of depth at running back, even after Keith Ford decided to transfer, so perhaps this was a legit move by OU officials for reasons unknown. Did the OU athletic department have a history with this woman? Are there other accounts of the event (i.e. other videos) that the media and others aren't taking into account?

    In any event, prepare for all the questions that come with the video's inevitable public release.

    The problem is, there are too many things for the national media to pick apart. The Mixon Tape, if released, would just be the icing on the cake.

    With Ray Rice, the NFL and the Ravens got to plea stupidity: "We never saw the complete video." OU can't plea that.

    Boren, Castiglione, and Stoops all saw it. They were very public about saying, we went to the DA's office, saw it, and everything's fine. He's suspended/(redshirted) for the year.

    You'd have the video on top of the WR from Mizzou that they were shilling for to the NCAA at the same time. The Frank Shannon thing, where they let him back on the team...not saying whether that was right or wrong. And, trying to junxtapose that with kicking a whole fraternity off campus over a video where no crime was committed.

    Like I said last fall, Boren & Co. can't have it both ways if the Mixon tape is released. It's bad press for the school at a time when people are freaking out about football in general and off-the-field football players' behavior specifically.

    They should have had Mixon publicly apologize instead of hiding him behind statement made by other people. It has never helped. The past PR fumble is what makes the future release of the incident problematic.

    Also, as stated before, it would have been over long ago - or, at least given us more cover - if they'd had Mixon out publicly showing contrition at every oppourtunity.

    It didn't happen. They didn't they chose to circle the wagon and play the "us against the world" card. So, predictably, once we got into the playoff, what was the national media interested in regarding Mixon? The punch...because they've left it unresolved in the public.

    Stupid. You'd think as a politician during the Clinton presidency, Boren would be smarter PR-wise.

    It could be a case of that's the way things are these days. Mixon's lawyer could have advised him to never say anything that could be perceived as admission of guilt. If he gets hit with a civil suit the second he declares for the NFL, it could turn out to be a wise tactic even though it's not very satisfying. (Note, I'm just assuming such a suit is still possible. If not, then never mind).

    I hope you are wrong about heads rolling. My first thought is that Boren Castiglione and Bob have a plan, fully aware from the beginning of the chance that it would come out.

    Ive also heard that the actual tape or recording, while public domain, is nowhere to be found. When I say "heard", I mean conjecture by a sports talk radio host who is somewhat plugged in....but also may be full of crap.
