Grassley: Tax Code Rewards Illegal Immigrants With Refunds

The nation's tax code "shouldn't reward those who broke our immigration laws," says Sen. Charles Grassley, who says he may file a bill prohibiting illegal immigrants from collecting back income tax refunds.

According to the IRS, immigrants can claim refunds for up to three years, even if they did not pay income taxes, reports The Washington Times.

Agency lawyers have determined that when a person gets a Social Security number, that makes them potentially eligible for tax refunds through Earned Income Tax Credit, even for people who for one reason or another did not file or pay taxes in years past.

"Section 32 of the Internal Revenue Code requires an SSN on the return, but a taxpayer claiming the EITC is not required to have an SSN before the close of the year for which the EITC is claimed," IRS Commissioner John Koskinen wrote in a letter to Grassley last week, repeating a conclusion that was reached in 2000 that was recently confirmed.

But Grassley, an Iowa Republican who chairs the Senate Judiciary Committee, said in a statement that the ruling makes a mockery of the nation's tax laws.

The issue could result in millions of immigrants being able to collect back refunds, as President Barack Obama's deportation amnesty order grants legal status, work permits and Social Security numbers for qualifying immigrants.

Previously, Koskinen said illegal immigrants must prove they worked off-the-books to claim the tax credit without having paid taxes, but it is not known how many people who could claim amnesty under Obama's plan.

General tax law allows anyone to go back and claim refunds for up to three previous years, but the IRS ruling creates a circumstance in which immigrants who did not pay taxes could get refunds, the Times reports. However, Obama's amnesty program does not require such people to pay the back taxes they may owe.

According to a recent Congressional Research Report, an immigrant benefiting from the first year of amnesty could claim more than $35,000 in child tax credits and EITC payments, reports Brietbart.

The average EITC in 2012 was $2,300 and in 2014 was $6,143, Grassley's office reported.

"Given the IRS’ interpretation of tax rules intended to prohibit undocumented workers from qualifying for the EITC, these individuals will be eligible to claim billions of dollars in tax benefits based on earnings from unauthorized work in the United States," Grassley said Monday.

"With the stroke of a pen, the president rewarded those working illegally in the United States with a tax benefit that is designed to encourage low-income individuals to enter the workforce," he continued. "Given that the IRS is intent on standing by its present interpretation of the eligibility requirements, I’m working on legislation to uphold an important principle that many of us in Congress support."

So because they did it we should give a pass to Obama for doing the same and implementing spending policies that insure the National Debt will keep increasing by 1/2 to 1 trillion dollars a year over the next 10 years. No POTUS will ever have to worry about getting the ND under control ever again because Presidents A,B and C didn't do anything about it...is that about right?

Yes, and you look at Greece, who had gotten themselves in big trouble financially/economically over their government entitlement programs exceeding their income, and they got a loan from the EU to bail themselves out, while adopting an "austerity" program to deal with their financial problems. Recently they elected a leftist who won re-election promising to cease their austerity efforts. You think, how damn stupid is that, in no time they will be back in the same fix, having to go back to the EU to request more funds.
I see the same exact thing happening here. When you destroy the very virtues that made this country great, self reliance and personal responsibility, and replace it with government welfare programs, convincing the populace that your are "entitled" to these handouts, then you create a class of dependency that then demands these government goodies. Over a period of time, this class of dependency naturally grows, with more and more people dependent upon the government to some degree or another. I believe we are right at 50% or thereabouts of the population that relies on some form of government benefit, be it food stamps, welfare, disability, public housing assistance, social security, on and on. Predictably, this number has grown to include a higher and higher percentage of people. This is why I have always referred to Socialism as a failed ideology. The very nature of it will lead to collapse over time.
The hard part about all of this is changing the people, you see it in Greece, and you can imagine if an austerity program was initiated here. The outrage over messing with their entitlements would be kayos and lead to insurrection. Riots would ensue and it would be a scene right out of Hollywood. Killing people to take from them what they need or want would be commonplace. Think Ferguson, but only in your neighborhood.

The positive effects of deficit spending are being negated by the sheer size of the debt and the cost of servicing that debt. The cheap cost of borrowing is killing savers and encouraging corporations to take on more debt that will in time hurt their bottom line. For example, over the last 6 years IBM has increased their debt(bond issuance) from $31 billion to $42 billion. Eventually that will kill their earnings and even with the lower guidance on earnings expectations equity prices will have to face the reality of the situation. I think we will see a huge fall in the equity market before Obama leaves office. That will herald the collapse of the Fed's easy money policy and the collapse of the debt bubble.

Well stated. So sad so many cannot or will not acknowledge the impending crisis that is sure to hit. Each and every time a politician tries to address the waste and corruption that is so prevalent in everything the Federal Government does, you have your statist goofs bring out the "You want to starve poor kids and roll granny over the cliff", the main stream media picks up on it with a human interest story on how this legislation will hurt so many people, and the responsible elected official then cowers down and drops his plans.
