OKLAHOMA CITY - A federal grand jury on Wednesday indicted a Moore physician on more than 50 counts alleging he illegally dispensed prescription medication to people, including an undercover investigator with theOklahoma State Board of Medical Licensure, authorities said.
Can D. Phung, 60, was charged with 51 counts of illegally dispensing controlled dangerous prescription drugs, one count of health care fraud and one count of falsifying patient records, according to a news release from U.S. Attorney John C. Richter's office.
Phung could not be reached for comment on Wednesday.
Prosecutors alleged that he illegally dispensed more than 4,500 tablets of the drugs outside the usual course of his medical practice and without legitimate medical purposes to four people.
He is accused of dispensing the painkillers Oxycodone-Percocet and Hydrocodone-Lortab, as well as anti-anxiety medication Alprazolam-Xanax; stimulant and appetite suppressant Phentermine and Methylphenidate-Ritalin, a nervous system stimulant.
Phung also is accused of billing Medicaid, through the Oklahoma Health Care Authority, for professional services in performing evaluation and management visits for patients he never saw, prosecutors said.
He also is accused of not performing appropriate medical histories or medical examinations and of falsifying entries in patient records that had been previously subpoenaed by the government.
According to the medical license board's Web site, Phung appeared before the board in September for a disciplinary hearing regarding alleged prescribing violations.
He could face up to 20 years in federal prison and a fine up of to $1 million, prosecutors said.
