True story.

I serve as the court appointed attorney for a two week stint twice a year on the mental health docket.

I represent persons arrested on mental health warrants that are involuntarily admitted to psychiatric wards.

Now these people are given two hearings, one a probable cause hearing w/n 72 hours of their incarceration, to prove that the officers had probable cause to detain the person, and a second "final" hearing w/n 10 days to determine if they need to be admitted to the hospital on a long term basis.

However, the doctors can release these people whenever they feel they are ready to be released, so 99% of the folks never see the final hearing.

You can also waive your hearings and just wait for the doctor to release you which usually happens quicker if you cooperate, so most of the time they will waive their hearings.

I had one guy who did not wish to waive his hearing and he wanted to go to court. So I tell him that when we go in there, I will read from the affidavit of the person who turned you in and you are to admit or deny it and if the Judge believes you, you will be set free.

He agrees and we go to court.

I put him on the stand and tell him that I am going to read from his file and he is to tell the Judge what really happened.

Now up until this point I hadn't really paid attention to what was written on the affidavit because he seemed to have his story straight so I figured he would just deny it all anyway and we could let the judge decide.

I begin to read to him from the affidavit, I say "It says here that you said to others that you believe you are a werewolf. Is that true?"

Softball, right? Easy deny.

Nope.

His response: "Yep. That's true."


So now the prosecutor is looking at me with a smile on her face and I am trying not to smile myself, so I think maybe my guy is confused, I will have to clear it up for him and make it even easier to deny.

So I say "It's true that you said you were a werewolf, or it's true that you believe you are a werewolf?"

His response: "I'm a werewolf."


My reply: "Umm... No more questions Your Honor, I'll pass the witness." :)
