dont they have to have some sort of court order to excavate the dead?

I think that's only for a gravesite, in this case, all they need is a search warrant or the present owner's permission.

Easy-peasy.Cops go to a judge and say "Your honor, we have reason to believe Jimmy Hoffa is buried in OUinFLA's backyard," or Giants Stadium or wherever. Judge says, "show me what you got." They do. Judge issues the warrant or order. They dig.

On MythBusters they used ground penetrating radar to check out the spots at Giants Stadium that are most often said to be where Hoffa rests.

I betcha can't guess what they found...
