I'm not sure what to think...

A rush to judgement/prosecute? (http://abcnews.go.com/GMA/LegalCenter/story?id=1858806&page=1)

There appears to be more questions regarding this "student" stripper. I use "student" in quotes becuase that is what they supposedly tell everyone...Not from personal experience, but from hearsay...

I think the DA is between a rock and a hard place here. If he doesn't bring charges, then he looks like a racist. If he does bring charges he's going to have a very difficult time proving the case (and he knows it) but feels like he has to in order to show he won't be bullied by the school.

Just seems to this dumb Okie that that gal might of been raped, but definitely not by these two fellers. I predict the state will drop all the charges after the DA election.

Oh yeah, I forgot. Here's how it will play out. These guys will either be acquitted or the charges dismissed...then the fun will start.

Stripper will then sue Duke, the kids, the NCAA and everyone else in sight and she'll get a LOT of money. The money will come from the settlement because the people she'll sue will want to pay her to make this go away.

I think you are exactly right, and this is going to set a precedent to
virtually eliminate parties on campuses.

Actually.. the party was off campus. That may save the school in terms of potential liability.

As for the indictments... there is an old saying .. "A grand jury could indict a ham sandwich." The D.A. goes in, presents the damning evidence only, and the standard at that point is not.. beyond a reasonable doubt.. but whether there is enough evidence to simply bring an indictment.

Ham sandwiches everywhere are trembling.

Lid, wouldn't the potential liability of such an enormous lawsuit force
institutions to proactively issue and enforce strict guidance on partys
that do take place on campus?

The Today show displayed several of the photos. Experts have apparently concluded the time stamps are correct, in part by looking at the watches seen in the photos. According to the timeline established by the accuser and the D.A., it seems pretty much impossible that either kid was involved in an attack. The one kid's circumstantial evidence (ATM receipts, cab ride, etc.) makes his alibi seem pretty much airtight.

They also showed a picture of the accuser apparently smiling as she walked out the door after the alleged rape should have happened, then laying on the porch something like two minutes after that, then getting into a car and leaving with a friend only moments after that.

It made the entire allegation of rape by anyone at that party look a little shaky.

Lid, I read somewhere where the house was either owned by the university or was on universit property. It was exactly clear to me, but Duke may not be off the hook there.

And my take on this is that the DA is pushing ahead because of the upcoming election...not because he is seeking justice. The guy that got fingered wasn't even there...the DA is going to look like a dickhead when it is all said and done.

Yeah, that! Thanks yermom. They should do that at the Renaissance Fair next year with the next couple people on death row. People would pay money to see that!

I think when the dudes are found innocent of all charges, they should sue the beyonce to receive all compensation from her porn career. :cool:
