Yahoo - Oklahoma five-star freshman running back Joe Mixon to be charged with misdeme

Following a three-week probe, the Norman (Okla.) Police Department turned over its investigation of Oklahoma freshman running back Joe Mixon to the Cleveland County District Attorney Greg Mashburn, who will charge Mixon with one misdemeanor count of an act resulting in gross injury. Mixon was involved in an altercation at Pickleman’s Café in Norman on July 25 in which he allegedly punched a female Oklahoma student in the face. The female OU student, 20-year-old Amelia Rae Molitor, told The Oklahoman that Mixon broke her “face in four places” with the punch. According to the police affidavit, Molitor, listed at 5-foot-6 and 130 pounds, was knocked unconscious and suffered "a fractured jaw, fractured cheek bone, fractured sinus, and fractured orbit which caused a hematoma on the left eye." Per SoonerScoop.com , Molitor told police the altercation stemmed from the 6-foot-2, 210-pound Mixon using a "homosexual slur" toward her friend. What happened next, as captured by surveillance footage, led to the misdemeanor charge against Mixon.* He lunged at her aggressively leading with his head and right fist. Molitor reacted by slapping Mixon with an open right hand around his left ear. Mixon then hit Molitor on the left side of her face, "knocking her into a table top and then to the ground where she laid motionless." Mixon then fled the scene.* Mashburn and Norman Police have the surveillance footage, but say it will not be made public. "We'll have to keep that in evidence because if we end up going to trial on this we'll have to show it to a jury and so that will be part of our case," Mashburn said. Mashburn also said that assault and battery charges were considered on both sides, as well as mutual combat, but ultimately Norman Police and he decided that the gross injury charge fit best. ""You can't look past the injuries to Ms. Molitor," Mashburn said . "You can't look past that it is a guy and a girl. I believe that this charge really fits because it deals with causing gross injury to a person, and that act was injurious to public morals. I think under the law that's exactly what we have here and the misdemeanor charge is appropriate." Mixon’s attorney, Kevin Finlay, has claimed throughout the investigation that his client acted "instinctively" and in self-defense. The employee who made the call told the operator that “some girl just got clocked in the face” and that the alleged victim was bleeding “pretty bad.” According to SoonerScoop.com , no charges will be filed against Molitor for her role in the situation. Oklahoma athletic director Joe Castiglione said that the university will "independently evaluate" the matter and will determine Mixon's status "at the appropriate time."
