For my auto accident from last Halloween, I've been offered $3000 for pain and suffering (injured hand). My medical bills, which insurance also pays, are about $3100. So they are offering to settle for $6100 total. Ive read that the average settlement is 2.1 times medical bills.

How much should I counter propose? Anyone recall the episode of Taxi when Louie's apartment went up in flames?

My mom suffered a slip and fall in a local restaurant and had to have back surgery. The insurance company offered $10 grand total (she's on medicare, so all of us picked up her medical tab). Apparently that was the limit he could do without legal action being started.

$6100 sounds awfully low by comparison.

How severe was the injury? Is your hand now deformed?
Did you miss work? If so, how long
Any long term consequences?
Did you have to stop doing normal actions...give up any sports?
Did it cause you to stop certain sexual pleasures...do you now miss a stroke when you switch hands?

That's the difference between a general commercial liability policy and an auto policy. A lot of times, insurance companies will just offer the policy max for no-fault premises liability claims to make it go away and maintain the business' goodwill. Not the same kind of deal for an at-fault auto accident.

insurance companies and adjusters don't make money by writing bigger checks. i don't think you'd be having that conversation if they weren't making more money by paying the guy that offers you X dollars.

It was my left hand and I'm left handed.

It was a dislocation. I had it wrapped for a month. I did not miss work, but had to do things one-handed with my right hand. No surgery.

The orthopedic specialist says there is no damage shown by an x-ray. There is a small lump on the palm of my hand, that he says is scar tissue that will gradually dissolve.

The hand is still tender and tight, like when I open a jar of pickles, I feel a pinch. There is not constant pain. Some fatigue in my hand if I write a lot. I would answer Phil's last question if I were not on a work computer.

The doctor said the tenderness will gradually fade away - maybe 6 months to a year. It's already been 8 months.

I asked the doctor is there is any chance of arthritis when I get as old as some of you ****ers, and he said, "probably not - maybe 10% chance, but you'll be old enough for medicare to pay for treatment." That's what he really said.

From what you describe, I'd be perfectly content to take the money and forget about it.

It may sound un-American not to haggle and squeeze for every last cent, but you can also "what if" yourself into a conniption.

Just me.

How bout you just tell the insurance company no thanks on the extra money, just take care of my hospital bill. Go out and get yourself hurt ever once in a while...rub some dirt on it. **** like this is whats wrong with this country...
