EUFAULA — A Checotah elementary school teacher is free on a $5,000 bond after being accused of raping a 16-year-old male student.

Michelle Diane McCutchan, 38, was charged Tuesday with two counts of second-degree rape and one count of sodomy.

The alleged crimes happened between Dec. 1 and May 11.

Court information alleges that McCutchan had sex with the boy on four occasions at her home and at least one time at the boy’s home.

The age of consent in Oklahoma is 16, but state law makes exceptions for adults in positions of authority over minors, such as teachers.

No, I would not. That's why I left specific gender references to the student and the teacher in my post. This is one of those areas where mechanical equality doesn't work. (Frankly, I am the father of a 19 year old daughter and she has several friends who would be lying like hell if they acted all outraged in a similar situation, but the power relations in our society being what they are, I have less trouble leaving the boyos to their own devices.)

Nor would I think it was okay if the teacher used any sort of threat to coerce performance from the male student.

My reading of this case, and I'm prepared to retract my opinion if I'm wrong, is that the teacher was hot for Johnny and Johnny was not averse. And then outside folk got all upset.

If every young man who's first sexual experience was with a significantly older woman ended up with mental problems, our society would be significantly more screwed up than it is today.

The article says she is an elementary school teacher and the guy is 16. I seriously doubt he is one of her students or even attends her school so does she really have any authority over him? NO and therefore, IMO, age of consent should apply and if any other 38 yr old woman wouldn't have been charged, then she shouldn't be either.
