2 of the 3 people who ran into my car with me in it, in a 7 month period, were taking on their cell phones. 2 didn't have insurance. All were women in their 20's. I have been in pain on a daily basis ever since.

He said that one of the first things almost all of them do when working an accident is check the drivers phone for sent/received messages...

Not sure what the legalities of it are...Maybe you can refuse to let them look at your phone, but I'm sure if it was an injury accident(maybe doesn't even have to be an injury)they can get a court order for your phone records...

If you are in an accident that involves injury or destruction of property for someone else, im certain that it is 100% legal and I cant imagine anyone whining about that (not saying you are whining Boomer, just in general)

Not saying I think people should be texting but its only one of a handful of things that distract people in the car. I mean I will use the excuse I had to look down at my speedometer or something

It is illegal in Albuquerque. Nonetheless, I was coming home from work one day in stop and go traffic. I glance to my left and the cop in the marked patrol car next to me is steering with his knees as he uses both hands to text.

"In the event that you experience a near fatal accident by individuals texting while driving, it is permitted and encouraged that you may pull to the rear of the offending vehicle and "pit" said vehicle. In the event that 3 or more witnesses view the near fatal accident and can testify that you did indeed "pit" the offending turd you will be rewarded with $5000, while the figure will go up if the "turd" gets ginormous air by a factor of 3."
