But if they did it in front of their home, would they have gotten into trouble? Doubtful. Obviously, the kids did their research -- they chose a high volume area. I understand why the regs are there, but I don't think it's overregulation.

If you paid less than $5 for it then yes...you should pay income taxes on it.

Now I know nobody actually does stuff like this, myself included, but the letter of the law says you should. Also, since you don't hold a sales tax permit the person that purchased the club should remit the sales tax to the State of Oklahoma.

Let's see... The parents gave money to the boys after that money had it's "fair share" of federal and state income taxes. They then paid sales tax on the raw ingridents they purchased. Then some poor sap paid $1 (again money earned after taxes) for the cupcakes and the government still wants more.
