There are some schools that could do anything whatsoever and never ever get the death penalty. USC, Notre Dame, Alabama, Penn State, and Texas.

SMU, the only school to get the death penalty, was blatantly cheating, practically daring the NCAA to do something about it. The NCAA in all likelihood will never levy the death penalty on a major college football program again, having seen the train wreck it made of SMU for so long. The ponies barely managed to keep playing Division 1 football and as much as the NCAA wants everyone to play by the rules (and not pay student athletes) they would hate to lose a program and you should be able to figure out why.

If there was going to be a second death penalty handed down, they would have done so for the Hart Lee Dykes debacle.
