View Full Version : Lawyer: Erin Andrews to sue over nude video

The sports world's obsession with Erin Andrews has taken a disturbing turn.


A lawyer for the popular ESPN sideline reporter says that she was unwittingly videotaped through a peephole in a hotel room without her consent and that she intends to take legal action against the still unknown perpetrators.

The video, which was later posted on the Internet, showed a woman in the nude. Reports say the initial video posting made no direct reference to Andrews being that woman, but her attorney later confirmed it.

"While alone in the privacy of her hotel room, Erin Andrews was surreptitiously videotaped without her knowledge or consent," Andrews' attorney, Marshall B. Grossman, said in a statement. "She was the victim of a crime and is taking action to protect herself and help ensure that others are not similarly violated in the future. Although the perpetrator or perpetrators of this criminal act have not yet been identified, when they are identified she intends to bring both civil and criminal charges against them and against anyone who has published the material. We request respect of Erin's privacy at this time, while she and her representatives are working with the authorities."

It was not clear from the reports what hotel the video was filmed in or when it was made. The video has since been pulled from the Internet.

ESPN also came to Andrews' defense.

"Erin has been grievously wronged," ESPN spokesman Mark Mandel said. "Our people and resources are in full support of her as she deals with this abhorrent act."


Andrews has been a subject of fascination ever since bursting onto the scene with ESPN. She was voted America's Sexiest Sportscaster by Playboy in 2007 and 2008.

She started working for ESPN in May 2004 as a member of their NHL coverage and has since covered numerous other sports, including college football and basketball, MLB and the College World Series.

Andrews also made headlines just 10 days ago when she was taken to a hospital after being hit on the chin by a foul ball during an MLB telecast.

Saw her on the MLB Home Run Hitting deal the other night. She looked pissed off at one point. She had done a color commentary with one of the guys still in the hunt and then was sitting in the stands. I didn't know about her getting hit in the chin nor about the release of this video...

Bottom line....she didn't look happy that night as the camera panned by her sitting there. While on camera...she was all smiles.

I saw a link on a rapid share site but I am not sure of its legitimacy so I am not going to click on it... that and I'm a chick with absolutely no interest in seeing a nekkid Erin Andrews.

However, for those of you desperate, here's how I found it --- google "Erin Andrews porn," click on the Yahoo Answers link, and there's a rapidshare.com link in one of the answers.

Again, I did not test the link and you might just end up at with a Rick Rolling... and I would laugh at you if you did.

I used to do this at a summer camp in a college dorm. The tricky camp counselors would turn off the hall lights so they could use the peep holes to determine who was staying up past lights out.

Unfortunately, I did not factor in that these counselors - who obviously feel the need to make sure that each and every light is out - were biking around the dorm to see which lights were on and off from the other side.

If she thinks she's performing any sort of legitimate sports journalism, she needs to take a long step back, look at the nature of the industry, and disabuse herself of that misconception as soon as possible.

Of course, if she and ESPN are suing with the argument that her physical form is a form of intellectual property owned by Disney, and that the video makers have infringed on their copyright, well, that would be horrible, beyond cynical, and completely predictable.

Not to argue, but how long would you need to stand at the door filming, to get a shot of her nekkid and some one not notice this odd behavior and finally, how do you do this without a monopole (heh) or tripod to steady the camera and get a usable shot. Seems way too implausible to do this without "someone" beside the photog noticing...

as far as getting caught, who knows what time that was, or if they had someone looking out for them. if i had to guess, i'd think it was someone that worked in the hotel that knew what room she was in

Are you f**king kidding me? The fact that she's a public figure is completely irrelevant, as are her looks and what she does for a living. She was in a private hotel room and she was violated. As far as I'm concerned this is nothing short of a sexual assault. How would you feel if something like this happened to your daughter, wife, girlfriend or mother? Would it be okay just because they are "pretty"?

If you guys want to look at naked women, there are tons of free internet porn sites around that feature willing participants. Hell, I don't even feel sorry for the Hollywood debu-sluts that wear short skirts and no panties and get their snatch photographed as they exit a limo. They were asking for it. This poor girl, however, was not and all of you that are watching that video should be ashamed of yourselves.

I'm not blaming her for anything at all. I'm just saying that all the outrage is a little hypocritical, as the primary reason for her success is because she's physically attractive. Not only that, but due to this demand for her allure being her primary moneymaker, it's only inevitable that something like this would happen.

Comes with the territory. Just like Hollywood celebs. They may hate the paparazzi, but they know that in many ways they increase their earning potential. It's a business.

Would I be pissed that it happened? Of course. Would I be mad at the guy who did it? Yeah, because he had no business invading the life of a private individual.

Is that the same as this case? No, because she's a public figure who essentially sells her sex appeal to make a substantial amount of cash. Do I find it disturbing that it happened? Yes, I made that case in the original statement. Am I angry at the guy who did it? No, because as I alluded to, the only real offense that he committed was to violate Disney's exclusive right to Erin Andrews' sex appeal. She's already agreed with the company that she'll use her physical attractiveness to make them money. Just like any number of Hollywood starlets.

For one, willing participant is a fairly relative term that skirts the boundaries of legality. Not everyone's in porn because they want to do it. Everyone's in it for the same reason Andrews is a sideline reporter - sex sells.

Is it wrong that she doesn't have control over the distribution of her sex appeal in this case? Yes, but that's theft/copyright infringement, not sexual assault.

What I am saying is that she shouldn't have this surprise and indignation that it happened like it was completely unexpected, because of her status as a public figure that's particularly based on her sex appeal. It comes with the job. Someone who doesn't have this status has much more right to the surprise and indignation, because they're private individuals, and there has never been any consent to any exploitation of their sex appeal for any sort of material gain.

@yermom - is she doing anything a 65 year old man couldn't do?

I agree that it is a terrible crime but assault? I'm sorry but I would bet the emotional impact of a real assault is generally orders of magnitude greater than the impact of having yourself video taped. I'm not meaning to minimize this situation and I realize impact is a very individual thing....

To suggest somebody who works in a visual medium should just "expect" things like this to happen or be "unsurprised" by it is absolutely ludicrous. In fact, it's f**king insulting.

The person who video taped clearly shouldn't have, and is in the wrong. The motivation for committing the action, on the other hand, is much different than that of a private citizen. It's more like theft than assault.

You are trying to force a connection between a superficial, sex-driven society and an individual's sacred (or at least semi-sacred) right to be left alone. It is absolutely NOT hypocritical for Erin Adrews to expect the same privacy - in a ***ing hotel room, fer cryin out loud - as any other person.

Many female sports reporters may well be eye candy; but to go from that proposition to "therefore they shouldn't be so shocked when a creep peeps into their hotel room" is a non-sequitur.

The person who video taped clearly shouldn't have, and is in the wrong. The motivation for committing the action, on the other hand, is much different than that of a private citizen. It's more like theft than assault.

You are correct. Theft of her privacy, theft of her peace of mind, theft of her sense of security, and the belief that a peeping tom who is sitting right outside her room, just might not get the feeling that he is tired of just looking and may want to graduate to sexual assault. Erin Andrews will never feel safe again.

You are trying to force a connection between a superficial, sex-driven society and an individual's sacred (or at least semi-sacred) right to be left alone. It is absolutely NOT hypocritical for Erin Adrews to expect the same privacy - in a ***ing hotel room, fer cryin out loud - as any other person.

Many female sports reporters may well be eye candy; but to go from that proposition to "therefore they shouldn't be so shocked when a creep peeps into their hotel room" is a non-sequitur.
