A family member was approached by a federal agent. He wants my relative to retrieve something for him. My relative asked, "Why don't you just get a search warrant?" This was his answer: "Sure, we could get a search warrant, but that would take time. It would just be a lot easier if you just got it for us."


WTF? Is it even legal for them to ask that? Very weird.

well it isnt legal for them to ask anything really in the course of an investigation. but thats about it. they can ask and request all they want and until there is a warrant you can say "kiss my shiny metal @ss"

A warrantless search/retrieval would be legal if the person consents to it. It could get sticky if your relative agrees to the search or giving the item up but later claims he or she was coerced or strong-armed into consenting. More facts needed.

If it was a federal agent, I am guessing the item(s) was: drugs/drug making items; hard drive of computer (child porn); financial/tax documents; firearm(s); cell phone or address book or answering machine tape. I might have guessed a copy of The Tin Drum, but it's a federal not state case.

just hypothetically speaking, generally, the cops can't recruit family members, or anyone else for that matter, to conduct warrantless siezures for them. The siezure is imputed to the cop under those circs.

OTOH, if your innocent wife gets PO-ed at you, and of her own accord, calls the cops and decides to hand them your stash, that's different. In that situation, you be toast. Thus, criminals do well to avoid spouses who aren't also in it up to their necks.

My uncle passed away last week. The day after his funeral, a federale walked up to my dad and told him that they wanted to inspect some of my uncle's belongings.

I guess I shouldn't share the nitty gritty details yet. I think there is going to be a huge bust in the next few months. Don't want to tip off the bad guys.

good point. I've seen all three Godfather movies and Goodfellas to boot. The Feds don't go to funerals just to pay their respects. They go to take pictures of who shows up.:eek:

Had a cop approach me to ask me about the existence, or not, of firearms in my home once. He did not know that I was an attorney and I certainly did not volunteer that information. When he began to ask questions I told him I did not care to participate. He then said, "Look, we can do this the easy way or the hard way, your choice."

When I asked him if the easy way was for me to give up all the rights guaranteed to me by the Constitution and the hard way was for him to do the job for which he had been trained and was being paid, he got all snippity. However, despite his snippiness he backed off.

I should tell you that I was in my late 40s at the time. I do not strongly recommend this course for a teenager or even an early 20s guy. In those cases the snippiness can and too often does result in an arrest for resisting a lawful order, if not a smack upside the head. They should not be able to win that one, but you are out a bunch of time, money and bad publicity to make the point that their behavior was wrong. Just tell them that without a warrant you cannot consent to a search.

Why do I suddenly have visions of Blutto (Belushi) in Animal House shrugging in feigned ignorance after they destroyed the car of Flounder's brother and decided to tell the insurance co. they don't know what happened?
