that throwing a brick thru someones' house window at night intending to kill them is burglary?
but if he threw the brick only intending to hurt the guy, its not burglary*.
This barzam stuff is making me want to choke someone to death.
Burglary: breaking into the dwelling house of another at night with intent to commit a felony therein.
*assault and/or battery are only misdemeanors, so only intending to hurt the person in the house won't do to make a burglary.
